Utility Models

Applications being novel and industrially applicable can be granted with a Utility Model Certificate which provides 10 years of protection.

Neither a search nor an examination are necessary for obtaining Utility Model Certificate. The certification is totally based on oppositions from third parties.

Requirements for filing

• Name, nationality and address of the applicant and inventor.
• If priority is claimed, number, date and country of the application.
• Specification, claims and drawings (if any)
• Priority Document, unlegalized. It may also be filed within 3 (three) months as of the Turkish filing date.
• Power of attorney simply signed by applicant. (It is not requested for filing but we prefer to have Applicant's POA in our files for future use.)

Stages

Filing

Patent application is filed to TPI with necessary documents and fees paid.

Formal examination

Within one month following to filing, TPI officials formally examines the utility model application and assigns a Turkish Patent Application number to the application.

Publication of the application

Within a month after the completion of the formal examination, utility model applications are published in Turkish Patent Bulletin for 3 months and during the term, third parties may file oppositions against the application.

Normally, publication is made within 18 months from the priority date, if any, or from the Turkish filing date. However, since the grant can only take place after the completion of the publication period, earlier publication is possible upon request in order to shorten the certification term.

Grant stage

Subsequent to completion of the publication, the TPI sends a grant decision including a request for the payment of the grant fee. Grant fees must be paid within 3 months from the date of grant. 2-3 months following the payment of the fees, the Patent Certificate is obtained.

Briefly, in case of a smooth procedure, the Utility Model certificate can be obtained within 12 months after filing.
