Turkey adopted EPC on November 1, 2000 and accordingly, granted EP applications filed on or after November 1, 2000 by designating Turkey can be validated.
Validation procedure is quite simple in Turkey and the key issue is a correct Turkish translation of a European Patent. In Bilen Patent, we have in house patent translators some having engineering background. All translations are also deeply reviewed by our patent attorneys in order to provide you with the best possible translation which will play a important role in case of any dispute in the future.
Patent application is filed to TPI with necessary documents and fees paid. A granted EP application has to be filed in Turkey within three months from the EP publication date of the grant. For completing filing, copy of said EP grant publication page is a must.
EP validations are formally examined by the TPI officials and a Turkish Patent number is assigned to the European Patent.
Approximately 2 months after the formal examination, EP validations are published in a Turkish Patent Bulletin as a Turkish Patent. After the publication, the EP validation will have the same rights as a national application.
Within 1-2 months after the publication, a Patent Certificate is obtained. No fees are paid for the certificate.
Briefly, within 4-6 months at the most, a European Patent is effectively validated in Turkey. On the other hand, it is possible to obtain a provisional protection in Turkey by publishing the claims of the European Patent in a Turkish Patent Bulletin prior to the grant decision.
