Overview

In conformity with the Decree Law 554 on the protection of the industrial designs, new and distinctive designs and aesthetic creations can effectively be protected in Turkey.

Mainly, there are two types of industrial design applications as colored and uncolored. Multiple applications are also possible provided that designs are in the same Locarno sub class.

On the other hand, the registration procedure is totally based on oppositions without any novelty search. The protection term is 25 years as long as renewal fees are paid in every 5 years counting from the filing date.

Requirements for filing

• Name and address of the applicant and designer.
• Representations and brief descriptions of the designs (8x8 cm). Representation can be prepared as drawing, picture, graphic, photograph or a similar way, but must clearly show all special characteristic of design and must be suitable to publish.
• Power of Attorney, simply signed by the applicant, legalization is not required.
• In case of claiming priority
  • Priority information (date, reference number)
  • Priority document ( to be filed within 3 months after the filing date)

Stages

Application & Formal examination

Subsequent to application, TPI officials formally examine the application and, within a month, TPI assigns a Turkish industrial design application number to the application along with a decision to publish the application.

Publication

Within a month after the formal examination is completed, industrial design application is published in TPI's endustrial design bulletin for 6 months. During the publication period, third parties can file their oppositions. The TPI can accept or deny the oppositions depending on their grounds.

Registration

Within two months after the publication term is expired, The TPI send Industrial Design Registration Certificates.

If summarized, in case of no oppositions, the certificate can be obtained within approximately 10 months after filing.
